Bertam Resort Water Park (BRWP) – Online Ticketing

GENERAL ACCEPTANCE

This page explains the terms and conditions governing the use of Bertam Resort Water Park (“BRWP”) online ticketing facility. Please read these Terms & Conditions carefully. By using the online ticketing facility, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of this service immediately.

BRWP reserves the right to amend these Terms & Conditions at any time without prior notice. Any revisions shall apply to all subsequent transactions. Continued use of the online ticketing facility constitutes acceptance of the revised terms.

The online ticketing facility enables customers to purchase BRWP admission tickets and related activities electronically via an internet connection.

ELIGIBILITY & AUTHORITY

By using the online ticketing facility, you represent and warrant that you are at least eighteen (18) years of age, of sound mind, and legally capable of entering into a binding contract.

Where multiple tickets are purchased in a single transaction, the purchaser represents and warrants that they act as an authorised agent for all other ticket holders and undertakes to bring these Terms & Conditions to their attention.

Parents or legal guardians acknowledge their responsibility to ensure that all accompanying minors comply with these Terms & Conditions and BRWP’s Park Rules & Regulations, and that reasonable care is exercised at all times.

DISCLAIMER & ASSUMPTION OF RISK

BRWP is an outdoor, self-directed recreational facility. Certain activities involve inherent risks which may vary depending on the behaviour, attitude, and physical condition of participants. By entering BRWP, you acknowledge and accept these inherent risks and agree to take all reasonable precautions for your own safety and that of others.

Admission to BRWP is subject at all times to BRWP’s Park Rules & Regulations, which are displayed at the park entrance and throughout the premises.

BRWP reserves the right, without prior notice and without liability, refund, or compensation, to close the park or any part thereof temporarily, restrict admission, modify operating hours, or suspend or alter attractions.

To the fullest extent permitted by law, BRWP shall not be responsible for any death, personal injury, or loss or damage to property. By accepting admission, you release BRWP and its related corporations from all liability arising from your visit.

BRWP reserves the right to refuse admission or expel any person whose conduct is deemed unsafe, disruptive, or prejudicial to park operations, without refund.

NO REFUND POLICY

All tickets purchased through BRWP’s online ticketing system are strictly non-refundable.

Once a transaction is successfully completed, no refunds, reversals, cancellations, exchanges, credits, or compensation shall be permitted under any circumstances, including but not limited to:

• Change of mind
• Failure to attend
• Late arrival
• Weather conditions
• Closure or suspension of attractions
• Operational, safety, or capacity-related decisions made by BRWP

Tickets that are unused, partially used, forfeited, or denied entry due to non-compliance with BRWP’s rules and regulations shall not be eligible for any refund, compensation, or credit, to the fullest extent permitted by law.

By purchasing tickets through BRWP’s online ticketing system, the purchaser expressly acknowledges and agrees to this no refund policy and waives any right to dispute or charge back the transaction on this basis.

NO CHANGE OF VISIT DATE OR TIME

All tickets purchased through BRWP’s online ticketing system are valid only for the specific date selected at the time of purchase.

No changes to visit date or visit time are permitted under any circumstances, including but not limited to:

• Personal scheduling conflicts
• Weather conditions
• Transportation delays
• Capacity limitations
• Operational or safety decisions by BRWP

Requests for amendments, rescheduling, substitutions, extensions, or partial changes—whether for individual tickets or group purchases—will not be entertained.

Failure to attend on the selected visit date shall result in the ticket being deemed forfeited, with no entitlement to refund, replacement, rescheduling, or compensation.

MANAGEMENT DISCRETION

Notwithstanding any provision contained herein, BRWP may, at its sole and absolute discretion, consider requests on a case-by-case basis subject strictly to management approval.

Any such consideration:

• Is purely discretionary
• Does not constitute any entitlement, right, or guarantee
• Shall not create any precedent
• Shall not give rise to any claim, expectation, compensation, refund, replacement, rescheduling, or benefit

In the event that BRWP, at its sole discretion, approves any refund, the final refund amount shall be subject to applicable administration fees, refund processing fees, and any other charges as determined by BRWP, and shall not be construed as a full or automatic refund.

The decision of BRWP’s management shall be final, conclusive, and binding, and BRWP shall not be required to provide reasons for any approval or rejection.

The submission or consideration of any request shall not be construed as a waiver of BRWP’s rights under these Terms & Conditions.

TICKETING & ENTRY

Each online purchase generates a unique QR Code, which must be presented for park entry on the selected visit date. QR Codes must be kept secure and private. BRWP reserves the right to deny entry where QR Codes are altered, duplicated, or misused.

RECEIPT

A digital receipt containing the QR Code will be issued upon successful purchase. Customers are responsible for safeguarding this receipt.

PRIVACY POLICY & PERSONAL DATA

By using BRWP’s online ticketing facility and/or entering BRWP, you consent to the collection, use, and processing of your personal data in accordance with BRWP’s Privacy Policy and applicable Malaysian laws.

This includes photographs, images, and videos captured during your visit, including the use of AI-based facial recognition systems to assist with photo identification and purchase. All images and recordings captured within BRWP premises are the intellectual property of BRWP.

If personal data collection is not permitted, certain services or experiences may not be available.

GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.

LIABILITY WAIVER

In consideration of Maritime Waterfront Suites Sdn Bhd (“BRWP”) granting admission and access to its facilities, I acknowledge and agree that:

• I voluntarily assume all risks associated with participation
• I am responsible for the supervision and safety of accompanying minors
• I shall comply with all park rules and safety instructions
• I indemnify and hold harmless BRWP from all claims, losses, damages, costs, and legal fees
• I am solely responsible for my personal belongings
• I consent to the use of my image and likeness for BRWP’s promotional and marketing purposes
• All information provided to BRWP is true and accurate

By purchasing tickets through BRWP’s online ticketing system, I confirm that I have read, understood, and voluntarily agreed to this Liability Waiver, and acknowledge that I am waiving certain legal rights.
